Article 1: General terms 

The e-commerce website of ifluo, a one-person business with registered office at Meilegemstraat 48, 9630 Meilegem, Belgium, VAT BE 0647.501.229, (hereinafter "ifluo") offers its customers the opportunity to purchase the products from its online shop online.  

These General Terms and Conditions ("Conditions") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order via ifluo's webshop, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions to the exclusion of all other conditions. Additional conditions of the Customer are excluded, except when previously, in writing and expressly accepted by ifluo.  

 
Article 2: Price

All prices stated are expressed in EURO, always including VAT and all other taxes or duties to be paid by the customer.    

If delivery, reservation or administrative costs are charged, this will be stated separately.    

The stated price refers exclusively to the articles as described. The accompanying photos are for decorative purposes only and may contain elements not included in the price.  

 

Article 3: Offer 

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up to date. Obvious mistakes or errors in the offer do not bind ifluo. ifluo is only bound by an obligation of means with regard to the correctness and completeness of the offered information. ifluo shall under no circumstances be liable in case of obvious material errors, misprints or printing errors. 

If the customer has specific questions e.g., about sizes, colour, availability, delivery time or delivery method, we request the customer to contact us in advance via email to ifluo.be@gmail.com. 

The colours of the items depend on your computer screen and settings. We cannot guarantee that your computer will display the colours accurately. 

The offer is always valid while stocks last and may be modified or withdrawn by ifluo at any time. Ifluo cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly mentioned in the offer. 

Article 4: Online purchases 

How do I place an order?  

  1. Click on the product that you want to order.  
  2. You will be taken to the product detail page.  
  3. Click on the green 'add to cart' order button.  
  4. If you want to add other products, click on the 'ifluo' logo in the top left and repeat steps 1 to 3. 
  5. Click on the shopping cart at the top right to complete your order.  
  6. Check the contents of your shopping cart and click 'Continue'.  
  7. Create an account or order without registration  
  8. Enter your name and address.  
  9. Indicate whether you want your parcel delivered to your home, a postal point or another address.  
  10. Choose the desired payment method  
  11. Check all details again and confirm the order.  
  12. You will be redirected to the secure page for payment.  
  13. Wait until payment is complete before closing the screen. If you close too quickly, the order may not be forwarded. 
  14. After ordering through the site, you will receive an automated e-mail confirming receipt of your order. The confirmation e-mail contains details of your order such as the order number, overview of the products ordered, prices, your shipping address, delivery costs and more. Also attached to this email is a pdf with the invoice for this order. Please note that the confirmation e-mail is NOT yet an acceptance of your order. 

How can I pay?  

To order your ifluo bag, you can pay in the following ways:

 If payment is made by bank transfer, the goods will be dispatched as soon as the total amount of the purchase is in ifluo's account. If payment has not been received after 14 days, the purchase is cancelled.  

When your order has been accepted by us, we will send you an e-mail confirming that all or part of the products have been dispatched. 

Once you have received the 'Dispatch Confirmation' e-mail, your order has been definitively accepted by us and the purchase agreement between you and us is complete in respect of the products dispatched at that time. The then current terms and conditions of sale will apply. No other terms and conditions will apply. 

The 'Confirmation of Shipment' e-mail will contain a non-amendable copy of the version of the terms and conditions of sale applicable at the time the purchase agreement was concluded, for your future reference. 

ifluo is entitled to refuse an order for the following reasons:   

  • An incomplete or fraudulent payment from the customer.   
  • Incomplete, incorrect or fraudulent information about your identity, payment details, billing details, shipping address  
  • If we discover that there was an error on our site regarding the products you ordered, for example an incorrect price or description  
  • If the products you ordered are unfortunately out of stock or no longer available  
  • If we suspect that you intend to resell the Products 

If your order is refused, we will contact you by e-mail as soon as possible and in any case no later than 7 days from the date of your order.  If we cannot accept your order because the products are no longer available, or there is an error in the price and/or other information on our site, we will refund you the amount you may have already paid for those products. 

Article 5: Delivery and execution of the agreement

Orders we receive before 3pm will be dispatched the same day. Do you order on Saturday or Sunday before 3pm? Then the package will be dispatched on Monday.  

It can always happen that delivery takes a day longer due to unforeseen circumstances (strikes, weather conditions, serious accident, ...). ifluo is not liable for these delays. 

Items are stored and shipped by Webship, Oudenaardestraat 84/51, 8570, Vichte, Belgium 

Delivery will be done by Bpost, PostNL, GLS or one of their partners.  

You can track the shipment of your products by clicking the "Track my order" link in the shipment confirmation e-mail. Please note that this link takes you to the courier's website, which is not controlled by us.  

Unless otherwise agreed or expressly specified, goods will be delivered to the customer's residence within 30 days of receipt of the order.   

If an order cannot or can only be partially carried out, the consumer will be informed about this no later than 7 days after the order was placed. In that case, the consumer has the right to dissolve the agreement without costs.  

Any visible damage and/or qualitative defect of an article or any other defect in the delivery must be reported by the customer to ifluo without delay.   

The risk of loss or damage passes to the customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the customer upon delivery to the carrier, if the carrier was instructed by the customer to transport the goods and this choice was not offered by ifluo. 

Article 6: Retention of title  

Items delivered shall remain the exclusive property of ifluo until paid for in full by the customer.   

The customer undertakes, if necessary, to inform third parties of ifluo's retention of title, e.g., anyone who might come to seize items which have not yet been paid for in full. 

Article 7: Right of withdrawal  

The provisions of this article apply only to customers who purchase items online from ifluo in their capacity as consumers.  

If the right of withdrawal applies:   

The customer has the right to revoke the contract within a period of 14 calendar days without giving reasons. 

The withdrawal period shall expire 14 calendar days from the day on which the customer or a third party other than the carrier and indicated by the customer acquires physical possession of the good.   

For contracts where the customer has ordered several goods in the same order to be delivered separately: "on which the customer or a third party other than the carrier and indicated by the customer acquires physical possession of the last good.";   

To exercise the right of withdrawal, the customer must inform ifluo of his decision to withdraw from the contract by an unequivocal statement via e-mail. The customer can use the model form for this purpose. 

To comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.  The client can use the withdrawal form. 

The customer must return or hand over the goods to ifluo, Meilegemstraat 48, 9630 Meilegem, Belgium or to Webship, Oudenaardestraat 84/51, 8570 Vichte, Belgium, without delay and in any event not later than 14 calendar days from the day on which he communicates his decision to withdraw from the contract to ifluo. The customer is on time if he returns the goods before the period of 14 calendar days has expired. 

The direct costs of returning the goods shall be borne by the customer. 

If the returned product is somehow reduced in value, ifluo reserves the right to hold the customer liable and claim compensation for any reduction in the value of the goods resulting from the customer's use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods. 

Only items that are in their original packaging, together with all accessories and invoice or proof of purchase can be taken back.  Please also return the bag clean. Dirty bags cannot be repaired or processed and will be returned to the original sender. The shipping costs are for the customer in this case.    

If the customer withdraws from the contract, ifluo shall refund all payments received from the customer up to that point, including standard delivery costs, to the customer within a maximum of 14 calendar days after ifluo has been informed of the customer's decision to withdraw from the contract. In the case of sales contracts, ifluo may wait until it has received all the goods back or until the customer has proved that he has returned the goods, whichever comes first. 

Any additional costs resulting from the customer's choice of a mode of delivery other than the cheapest standard delivery offered by ifluo shall not be refunded. 

Ifluo shall reimburse the customer using the same means of payment with which the customer made the original transaction, unless the customer has expressly agreed otherwise; in any event, the customer shall not be charged for such reimbursement. 

If the consumer exercises his right of withdrawal, all ancillary contracts shall be terminated by operation of law.  

The right of withdrawal does not apply to products manufactured according to consumer specifications, which are not prefabricated and which are manufactured on the basis of an individual choice or decision by the consumer, or which are clearly intended for a specific person. 

 Article 8: Guarantee 

Pursuant to the Act of 21 September 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. This legal guarantee applies from the date of delivery to the first owner. Ifluo provides a 2-year warranty on ifluo items.  

This guarantee covers seams that are stitched too short, loose shoulder straps, faulty zips and faulty locks. Items not covered by the guarantee are: holes or tears in the fabric. 

To invoke the guarantee, customers must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.  

For items purchased online and delivered to the customer's home, the customer should contact ifluo and return the item to ifluo at his expense. 

If a defect is detected, the customer must inform ifluo as soon as possible. In any event, any defect must be reported by the customer within a period of 2 months after its discovery. Thereafter, any right to repair or replacement expires.   

If the original product is no longer available, you will receive an equivalent product.  

If the product is repaired, this may take 3 to 4 weeks.   

The warranty (commercial and/or legal) is never applicable to defects arising as a result of accidents, neglect, falls, cutting or use of the item contrary to purpose for which it was designed, non-compliance with the instructions for use or manual, modifications or alterations to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use. 

Damage to or loss of bag contents or similar costs are not eligible for reimbursement. 

Article 9: Customer service - complaints  

Ifluo's customer service can be contacted via e-mail ifluo.be@gmail.com or by post at the following address Meilegemstraat 48, 9630 Meilegem, Belgium.   

Complaints on the performance of the contract must be submitted to ifluo, fully and clearly described, within 7 days of the consumer discovering the defects. 

Submitted complaints will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the entrepreneur will respond within the 14-day period with a notice of receipt and an indication of when the consumer can expect a more detailed answer.  

In any case, the customer must give ifluo 4 weeks to resolve the complaint by mutual agreement. After this period, a dispute arises that is open to the Disputes Committee. 

Article 10: Penalties for non-payment 

Without prejudice to the exercise of other rights available to ifluo, in the event of non-payment or late payment, the customer shall be liable, ipso jure and without formal notice, to interest of 10% per annum on the unpaid amount from the date of the default. Furthermore, the customer shall be liable, ipso jure and without formal notice, to pay a fixed indemnity of 10% on the amount concerned, with a minimum of €25 per invoice. 

Notwithstanding the above, ifluo reserves the right to take back items that have not been paid for (in full). 

Article 11: Privacy 

The companies who are responsable for processing your order, ifluo and Webship, shall respect the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal data.  

The personal data you provide shall be used solely to process the order 

You have a legal right to access and possibly correct your personal data. Subject to proof of identity (copy of identity card), you can obtain written notification of your personal data free of charge by sending a written, dated and signed request to ifluo, Meilegemstraat 48, 9630 Meilegem, Belgium, iflluo.be. If necessary, you can also ask to correct any data that might be incorrect, incomplete or irrelevant. 

We treat your data as confidential information and will not transfer, rent or sell it to third parties.   

Customers are responsible for keeping their login data and password confidential. Your password is stored encrypted, so ifluo does not have access to your password. 

Ifluo keeps online (anonymous) visitor statistics to see which pages of the internet site are visited to what extent.

Article 12: Use of cookies 

During a visit to the site, 'cookies' may be placed on your computer's hard drive. A cookie is a text file placed by a website's server in your computer's browser or on your mobile device when you consult a website. Cookies cannot be used to identify individuals; a cookie can only identify a machine. 

What types of cookies are used and what for:  

'First party cookies' are technical cookies used by the visited site itself, whose purpose is to make the site function optimally. E.g.: settings made by the user during previous visits to the site, or even : a pre-filled form with data the user has done during previous visits. 

'Third Party cookies' are cookies that do not come from the website itself, but rather from third parties, e.g. a marketing or advertising plug-in present. E.g. cookies from Facebook or Google Analytics. Such cookies require the site visitor's prior consent - this can be done via a bar at the bottom or top of the website, referring to this policy, which however does not prevent further browsing on the website].

Article 13: Infringement of validity - non-violation 

If any provision of these terms and conditions is declared invalid, unlawful or void, this shall in no way affect the validity, legality and applicability of the other provisions.   

The failure at any time by ifluo to enforce any of the rights enumerated in these terms and conditions, or to exercise any right thereof, shall never be deemed a waiver of such provision and shall never affect the validity of such rights. 

Article 14: Amendment of terms and conditions   

Ifluo may change the Terms and Conditions at any time and without notice. 

Article 15: Evidence 

The customer accepts that electronic communications and backups may serve as evidence. 

Article 16: Applicable law - Disputes 

Contracts between the entrepreneur and the consumer to which these general terms and conditions relate are exclusively governed by Belgian law.  

Disputes between the consumer and the entrepreneur about the conclusion or execution of contracts relating to products and services to be delivered or supplied by this entrepreneur, can, with due observance of the following provisions, be submitted by both the consumer and the entrepreneur to the consumer ombuds service https://consumerombudsman.be/en 

If the customer wishes to submit a dispute to the consumer ombudsman service, ifluo is bound by this choice. Preferably, the consumer notifies the entrepreneur first.  

When ifluo wishes to submit a dispute to the consumer ombudsman service, the consumer shall, within five weeks after a written request to that effect by the entrepreneur, state in writing whether he so wishes or wishes the dispute to be dealt with by the competent court. If ifluo does not hear the customer's choice within the five-week period, ifluo shall be entitled to submit the dispute to the competent court. 

The Consumer Ombudsman Service issues rulings under the conditions set out in the Ombudsman Service Regulations. The decisions of the Consumer Ombudsman Service is a binding opinion.  

Only the court in Ghent has jurisdiction in legal disputes.
